Our Purchase Agreement – Terms & Conditions

1. House Plan License Agreement

By purchasing a stock plan or engaging JL Barndominium Artists for custom design services, the customer (Licensee) agrees to the terms of this agreement, which grants a single-use license.

2. License Terms & Copyright

2.1 Single-Use License
When you purchase stock plans or custom design services from JL Barndominium Artists, you are purchasing a license to build one single residence. This license may not be used to build multiple structures. If you wish to build the same plan again, an additional license must be purchased.

2.2 Multi-Use License
If you are interested in building the plan more than once, you must request and purchase a multi-use license separately in writing. Otherwise, all purchases are considered single-use only.

2.3 Non-Transferable
Your license is for your personal use only. Plans may not be sold, shared, transferred, copied, or distributed to anyone else without written consent from JL Barndominium Artists.

2.4 Copyright Protection
All plans, designs, renderings, and related content remain the property of JL Barndominium Artists and are protected under U.S. copyright law. Unauthorized reproduction, resale, or distribution is strictly prohibited.

2.5 Ownership of Custom Designs
Any custom or modified plans created through our services remain the intellectual property of JL Barndominium Artists. You are granted a license to build the home but not ownership of the underlying design.

2.6 Anti-Infringement Measures
Plans may include digital watermarks or other identification methods to prevent copyright infringement and unauthorized use. JL Barndominium Artists actively monitors for misuse and will pursue violations to the fullest extent of the law.

2.7 Refund Policy
Due to copyright protections, all sales are final. No refunds, returns, or credits will be issued for stock plans, custom designs, or modifications once an order has been processed.

3. Scope & Disclaimers

3.1 Scope of Services
JL Barndominium Artists provides architectural design services only. Our plans are intended for use as design guidelines and may include elements such as floor plans, elevations, roof plans, electrical layouts, plumbing layouts, and other builder-ready drawings.

3.2 No Engineering or Construction Services
JL Barndominium Artists does not provide structural engineering, construction supervision, or contractor services. Structural elements such as footings, beams, load paths, and soil conditions must be reviewed and approved by a licensed engineer in the state where the building will be constructed.

3.3 Engineer Review Requirement
All plans must be reviewed and approved by a local, state-licensed structural engineer or building professional before construction begins. This step ensures compliance with local codes, soil conditions, wind, seismic, and load requirements.

3.4 Responsibility of Builder/Client
It is the responsibility of the builder, contractor, and/or client to:

  • Verify all dimensions, materials, and specifications on site.

  • Ensure construction follows all applicable building codes and regulations.

  • Report any discrepancies, conflicts, or concerns to JL Barndominium Artists before proceeding with related work.

3.5 Consistency Disclaimer
Notes or indications in the plans regarding structural items (such as footings, beams, or load paths) are provided as guidelines only. Final specifications must be verified and approved by a licensed engineer before construction. In case of conflict, the engineer’s requirements take precedence.

3.6 No Warranties
All plans and materials are provided “as is,” without warranties of any kind. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, or compliance with any specific jurisdiction’s codes or requirements.

3.7 Not Responsible for Construction Methods
JL Barndominium Artists is not responsible for construction methods, techniques, sequences, safety standards, workmanship, or negligence caused by contractors, subcontractors, or builders during implementation of the plans.

3.8 Code Compliance
Plans are designed to meet generally accepted standards and codes at the time of creation. However, codes and regulations vary by state, county, and municipality. It is the client’s responsibility to ensure compliance with all local, state, and federal building requirements.

3.9 Plan Accuracy
While accuracy is a priority, JL Barndominium Artists is not responsible for typographical errors, technical inaccuracies, or omissions within the plans. JL Barndominium Artists reserves the right to make updates or improvements without prior notice.

3.10 Hold Harmless Agreement
By purchasing and using the plans, the client agrees to indemnify and hold JL Barndominium Artists harmless from any claims, costs, or damages arising from construction, including structural or engineering requirements not approved by a licensed engineer.

3.11 Builder Obligation
Builders and contractors must review all plans before construction and notify JL Barndominium Artists of any discrepancies. Failure to do so releases JL Barndominium Artists from liability for resulting issues.

3.12 Lot Conditions & Measurements
It is the Licensee’s responsibility to verify all lot conditions, site measurements, and setbacks before construction begins. JL Barndominium Artists is not liable for issues or costs arising from inaccurate site data or failure to confirm these conditions in advance.

4. Liability & Limitations

4.1 Limited Liability
Liability for any claim, dispute, or issue arising from the purchase or use of JL Barndominium Artists’ plans or services is strictly limited to the original purchase price paid. No additional claims for damages, losses, or costs will be considered under any circumstances.

4.2 No Responsibility for Construction Errors
JL Barndominium Artists is not responsible for construction errors, material losses, delays, or additional costs resulting from:

  • Failure to verify dimensions on site.

  • Failure to obtain engineer review and approval.

  • Changes made without our knowledge or consent.

  • Deviations from the final approved plans.

4.3 External Factors
JL Barndominium Artists shall not be held liable for delays, disruptions, or inability to deliver services due to circumstances beyond our control, including but not limited to natural disasters, acts of war, labor strikes, supply chain issues, or technology failures.

4.4 Client & Builder Responsibility
By using our plans, the client and builder accept full responsibility for ensuring compliance with all applicable building codes, zoning laws, and construction standards.

4.5 No Indirect Damages
JL Barndominium Artists will not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, delays in construction, or additional financing costs.

5. Payment & Pricing

5.1 Payment Requirement

Full payment is required before JL Barndominium Artists begins any work, including stock plans, modifications, or custom design services. No exceptions apply.

5.2 Accepted Payment Methods
Payments are processed securely through our online system. We accept all major credit cards via Stripe. Other payment methods such as checks, wire transfers, or cash are not accepted.

5.3 Stock Plan Purchases
When purchasing stock plans through our website, payment must be made in full at checkout. Plans will not be delivered until payment has cleared.

5.4 Invoiced Services
For services billed by invoice — including plan modifications, redesigns, or custom plans — full payment is due prior to the start of design work.

6. Revisions Policy

6.1 Included Revisions
All custom design packages include unlimited revisions at no additional cost during the active project period.

6.2 Revision Window
Unlimited revisions remain available for 30 days after the final blueprints have been delivered. After this 30-day period, the project will be considered complete.

6.3 Revisions After Completion
Any requests for revisions made after the 30-day window will incur an additional fee.

6.4 Definition of Revisions
Revisions are defined as adjustments to the existing custom design. This may include changes such as room dimensions, wall placements, window or door locations, or the addition/removal of features.

6.5 New Designs
A completely new layout, floor plan, or building concept is not considered a revision. Creating an entirely different design from scratch requires the purchase of a new package.

7. Miscellaneous Terms

7.1 Force Majeure
JL Barndominium Artists shall not be held liable for delays, disruptions, or inability to deliver services due to circumstances beyond our control, including but not limited to natural disasters, acts of war, labor strikes, supply chain issues, or technology failures.

7.2 Copyright Enforcement
All plans, renderings, and related materials are protected by U.S. copyright law. Unauthorized use, reproduction, or distribution will be pursued to the fullest extent of the law, including claims for damages and recovery of legal fees.

7.3 No Guarantee of Local Approval
Plans are created to meet general standards at the time of design. However, municipalities may require plan reviews, stamps, or certifications by local licensed professionals. Obtaining such approvals is solely the client’s responsibility.

7.4 “As-Is” Delivery
All plans and specifications are delivered “as is” without warranties of any kind, including implied warranties of merchantability or fitness for a particular purpose.

7.5 Updates & Corrections
JL Barndominium Artists assumes no responsibility for typographical errors, technical inaccuracies, or omissions in the documents. We reserve the right to make updates or corrections at any time without prior notice.

7.6 Entire Agreement
These Terms of Service represent the entire agreement between JL Barndominium Artists and the client. No verbal statements or outside representations shall alter or override these terms.

8. Local Engineer Review Requirement

Because building codes and requirements vary across all 50 states — including soil conditions, wind and snow loads, seismic activity, fire risk, zoning rules, and other regional factors — all plans from JL Barndominium Artists must be reviewed and approved by a licensed local engineer with knowledge and experience in your area, before you begin building your home. This step ensures the design is properly adapted to site-specific conditions and complies with all local, state, and federal codes. If your local engineer or building department requires any changes, please let us know — we will adjust your plans at no extra cost. All of our packages include unlimited revisions to make sure the plans meet your needs. JL Barndominium Artists is not liable for construction issues, added costs, or delays resulting from failure to obtain this required review.
